RO Defender turns collision repair estimates into documents you can put in front of someone who owes you money. These terms cover what we promise, what we do not, and how the subscription works. Section 2 is the one worth reading closely — it explains the limits of what the software can tell you.
1This agreement
These Terms of Service govern your use of RO Defender, a web application operated by Yash Patel d/b/a RO Defender (“RO Defender”, “we”, “us”). By creating an account or using the service, you agree to them. If you are agreeing on behalf of a shop, firm, or other organisation, you confirm you have authority to bind it, and “you” means that organisation.
If you do not agree, do not use the service.
2What RO Defender does — and what it does not
RO Defender reads collision repair estimates you upload and produces documents from them: a line-by-line comparison of two estimates, and a restatement of a single estimate as a schedule of values. That is the whole of it. It is document preparation software.
It is not advice.Nothing the service produces is legal advice, an insurance appraisal, an umpire or arbitrator's determination, an accounting opinion, or a professional certification of any kind. We are not your lawyer, adjuster, or accountant.
Its output depends entirely on its input. The documents are derived from the estimate files you supply. Where those files are incomplete, inconsistent, mis-scanned, or wrong, the output will reflect that. Automated matching of line items between two estimates is an inference, not a certainty, and it can pair the wrong lines or miss a pairing altogether.
You must review before you rely. You are responsible for checking any document against the underlying estimates before sending it to an insurer, presenting it in a negotiation, or putting it in front of a mediator, arbitrator, or court. We make no representation that any output is accurate, complete, admissible, or persuasive, and no representation about any amount you may or may not recover.
RO Defender does not write, transmit, or file estimates with any insurer or estimating system, and provides no path to do so.
3Your account
You need an account to use the tools. You agree to provide accurate registration information, to keep your credentials confidential, and to be responsible for everything done through your account.
Accounts are for a single user. Do not share credentials. If you need access for several people at your shop, contact us — tell us before you share a login, not after.
Tell us promptly at yash@rodefender.com if you believe your account has been accessed without your authorisation.
4Subscriptions, billing and cancellation
There are two ways to buy, both shown on the pricing page, and both exclusive of any sales or use tax, which is added where applicable. There is no free tier and no trial.
Monthly plans are unlimited for the tools they cover — no per-document charge and no usage metering.
A single document is a one-time purchase covering one estimate, from upload to finished document. That includes producing it again after you adjust the review, for as long as you keep the run — it is one estimate processed, not one file downloaded. It does not cover a different estimate: once a run has produced a document, its files are fixed, and a new estimate is a new purchase. Single documents do not expire and do not renew.
Your subscription renews automatically each month until you cancel, and your payment method is charged at the start of each billing period.
You can cancel at any timefrom Account & billing, which opens the Stripe billing portal. Cancellation takes effect at the end of the period you have already paid for; your access continues until then, and you are not charged again.
Fees already paid are non-refundable, including for any unused portion of a billing period and for a single document once it has been produced. Cancelling a plan stops future charges; it does not refund the period you are in, and you keep access for the remainder of it. An unused single-document purchase stays on your account until you use it.
We may change prices. If we do, the new price applies from your next billing period after we have given you notice, and you may cancel before it takes effect. A plan you have already bought continues to grant the tools it granted when you bought it; a tool released later is not automatically added to it.
If a payment fails, we may suspend access until it succeeds.
5Your files and what we do with them
Your files remain yours. Uploading an estimate gives us no ownership of it.
You grant us a limited, non-exclusive licence to store, process, and transform the files you upload strictly for the purpose of operating the service and producing the documents you asked for, and for diagnosing problems you report. That licence ends when the files are deleted.
We do not use your files to train machine learning models and we do not sell them, share them with other customers, or publish them.
You are responsible for having the right to upload what you upload. Estimates routinely contain personal information about people who are not you — vehicle owners, claimants, adjusters — and you confirm you have the authority to provide it to us for processing. 6Acceptable use
You agree not to:
- upload files you have no right to provide, or that contain malicious code;
- use the service to produce a document you know to be misleading, or alter its output and present it as generated by RO Defender;
- attempt to access another customer's account, submissions, or documents;
- probe, scan, or test the security of the service, or circumvent any authentication, entitlement, or rate limit;
- resell, sublicense, or provide the service as a bureau to third parties without our written agreement;
- scrape, or use automated means to extract the service's output in bulk;
- reverse engineer the service except where that restriction is unenforceable by law.
7Third-party names
RO Defender reads estimate files produced by third-party estimating systems, and names them so you know what the tools accept. CCC, CCC ONE, Mitchell, Audatex, and any insurer names are the trademarks of their respective owners.
RO Defender is not affiliated with, endorsed by, sponsored by, or certified by any of them — not CCC Intelligent Solutions, not Mitchell International, not Solera/Audatex, and not any insurance carrier. References to them are nominative, describing file formats and workflows the service interoperates with.
8Availability and changes to the service
We aim to keep the service available but do not promise any particular uptime. We may modify, suspend, or discontinue features, and we may perform maintenance that makes the service temporarily unavailable.
If we discontinue a tool you are actively paying for, we will give you reasonable notice and stop billing you for it.
The service depends on third-party infrastructure — hosting, storage, authentication, and payment processing. An outage at one of those providers can take the service down with it. Those providers are listed in our Privacy Policy.
9Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the service will be uninterrupted or error-free, that defects will be corrected, or that any document it produces will be accurate, complete, or suitable for any particular use, including any use in a claim, negotiation, appraisal, arbitration, or legal proceeding.
10Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost goodwill, or amounts you did or did not recover on any claim, however caused and on any theory of liability.
Our total aggregate liability arising out of or relating to the service or these terms will not exceed the total amount you paid us in the twelve months immediately before the event giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that applies to you, the exclusions and limitations above apply only to the extent permitted.
11Termination
You may stop using the service at any time and cancel your subscription as described above.
We may suspend or terminate your access if you breach these terms, if your payment fails and remains unpaid, or if we are required to by law. Where the circumstances allow it, we will tell you first and give you a chance to put it right.
On termination, your right to use the service ends. Handling of your files after that is described in How long we keep information.
12Changes to these terms
We may update these terms. When we make a material change we will update the date at the top and notify you by email or in the app before it takes effect. Continuing to use the service after that means you accept the updated terms; if you do not, cancel your subscription.
13Governing law
These terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws rules. The state and federal courts located in New Jersey have exclusive jurisdiction over any dispute arising out of or relating to them, and both parties consent to venue there.
